Drug Distribution Laws in Massachusetts

Drug distribution consists of engaging in a drug transaction where you transferred illegal substances to another person. The quantity that was distributed is irrelevant – no matter how small the amount involved you can still be arrested and charged with this crime. Possession with intent to distribute is another charge related to controlled substances. In that offense, evidence is generally found such as bagged drugs, scales, cash, and other evidence which indicates you are a distributor and not using the drugs for yourself.

Distribution of Class A, B, and C drugs categorized under Massachusetts law which include cocaine, heroin, methamphetamine, and other narcotics and prescription drugs is charged as a felony. Distribution of Class D and E drugs is generally charged as a misdemeanor but can still pose serious penalties.

A drug distribution charge may be based on an actual transfer of drugs or an attempted transfer which is prevented from being finalized. You can also be charged with this crime for having the intent to distribute which is shown by your actions and / or the quantity of drugs found in your possession.
