Cocaine Laws in Massachusetts
Cocaine is listed under Massachusetts' schedule of controlled dangerous substances in Class B. If you are found possessing or distributing cocaine, you will be charged with a felony. A first offense is punishable by a mandatory minimum jail sentence of a year or up to 10 years in prison, up to $10,000 in fines, and three years of a mandatory loss of your license.
A second offense of possession or possession with intent to distribute cocaine carries penalties of a mandatory minimum jail sentence of two years up to 10 years in a state prison, up to $25,000 in fines, and a four-year license loss. Aggravating factors which can influence the penalties include selling to minors or carrying or using a gun while in commission of the crime.
If you are accused of drug trafficking, you will likely face even stiffer penalties upon a conviction. The penalties for trafficking in cocaine are based on the quantities involved in the arrest. 14 to 28 grams of cocaine trafficking is punishable by three to 15 years in prison and fines of $2,500 up to $25,000. Quantities above 28 grams will result in harsher penalties.
