If you are convicted of cultivating or selling 50 pounds or less of marijuana product you will face criminal penalties based on whether you are a first-time offender or a repeat offender. For a first offense, you will face up to two years in prison and a fine of $500 up to $5,000. If you are convicted for a second or subsequent cultivation offense, the penalties imposed include up to two and a half years in prison and a fine of $1,000 up to $10,000.

The criminal offense of the sale or cultivation of 50 to 99 pounds of marijuana is a felony punishable by a prison term of one year up to 15 years and fines of $500 up to $10,000. The rest of the increments involved in the scale of penalties are:

  • 100 to 1,999 pounds punishable by three to 15 years in prison and fines of $2,500 to $25,000 with a mandatory minimum sentence of three years
  • 2,000 to 9,999 pounds punishable by five to 15 years in prison and fines of $5,000 to $50,000 with a mandatory minimum sentence of five years
  • 10,000 or more pounds punishable by 10 to 15 years in prison and fines of $20,000 up to $200,000 with a mandatory minimum sentence of 10 years

Additional penalties will be incurred if the above offenses are committed within a specific distance from a school or park or if a minor was used in the commission of the crime.
